Terms & Conditions
Effective date: January 1, 2026.
These Terms & Conditions (“Terms”) govern your access to and use of the Themex platform at themex.ca. By accessing the platform you agree to these Terms. If you do not agree, do not use the platform.
1. Services
Themex provides a browser-native design systems platform including a systems library, interactive instruments, frameworks, blueprints, field notes, and an academy. Features vary by plan level (Free, Builder, Studio).
2. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Themex is not liable for losses resulting from unauthorised account access where you have failed to maintain adequate security.
3. Acceptable use
You may not: use the platform for unlawful purposes; attempt to circumvent access controls; reverse-engineer or scrape platform content at scale; or resell platform access without a written reseller agreement.
4. Intellectual property
Platform content, systems, instruments, and educational materials are owned by Themex or its contributors. Free plan systems are licensed for personal use only. Builder and Studio plan systems are licensed for commercial client projects. Generated CSS output (tokens, :root blocks) produced by the instruments is yours to use without restriction.
5. Payments and cancellation
Paid plans are billed monthly or annually as selected. You may cancel at any time. Refunds are available within 7 days of initial payment on request. No refunds are issued for partial billing periods after the 7-day window.
6. Limitation of liability
Themex is provided “as is.” To the maximum extent permitted by law, Themex and its contributors are not liable for any indirect, incidental, or consequential damages arising from your use of the platform.
7. Governing law
These Terms are governed by the laws of Ontario, Canada. Disputes will be resolved in the courts of Ontario.
8. Changes
We may update these Terms. Continued use after changes constitutes acceptance. Material changes will be communicated by email to registered users.
